5. Law Enforcement Protocol

DownTime Dating is committed to protecting your privacy. We do not voluntarily share your information with government agencies or law enforcement. When we do cooperate with legal authorities, we do so only when required by law and only to the extent legally required — nothing more. This section explains exactly how we handle those situations so you always know where we stand.

5.1 Types of Legal Requests We May Receive

From time to time, law enforcement or courts may contact us with a legal request for user data. Here are the types of requests we may receive and what each one means:

• Subpoena (civil or criminal): A formal legal demand requiring us to produce specific records. Subpoenas carry a lower legal threshold than other request types — they do not require a judge to find probable cause. We review every subpoena carefully and challenge those that are overbroad or improper.
• Court Order (18 U.S.C. § 2703(d)): A court order under the Stored Communications Act requires law enforcement to show specific and articulable facts demonstrating that the records sought are relevant and material to an ongoing criminal investigation. This is a higher standard than a subpoena.
• Search Warrant (Federal Rules of Criminal Procedure): The highest legal standard. A search warrant requires a judge to find probable cause — a reasonable basis to believe a crime has occurred. A valid search warrant may authorize access to private message content. We require strict compliance with all warrant requirements before producing any content.
• Emergency Disclosure Request: In rare situations, law enforcement may request information without formal legal process when there is a good-faith belief of imminent risk of death or serious physical harm to a person. We evaluate these requests carefully and may disclose only limited, strictly necessary information. (See Section 5.5 for details.)

5.2 Our Legal Review Process

Every request we receive goes through a thorough internal review before we take any action. Specifically:

• Every request is reviewed by our legal team for legal validity, proper jurisdiction, and appropriate scope.
• We reject requests that are overbroad, lack proper legal authority, or violate applicable law. We will challenge improper requests in court when appropriate.
• We produce only the minimum data legally required — no broader disclosure than what the legal process demands.
• We maintain detailed records of all law enforcement requests received and the actions we took in response.
• We comply with applicable federal law, including the Stored Communications Act (18 U.S.C. §§ 2701–2712), the Electronic Communications Privacy Act (ECPA), and applicable state laws.

5.3 User Notification

We believe you have a right to know when law enforcement seeks your information. Our notification practices are as follows:

• DownTime Dating will notify affected users of law enforcement requests before complying, when legally permitted to do so, so that you have the opportunity to seek legal counsel or file a motion to quash.
• We will delay notification only when: (a) a court issues a non-disclosure or gag order, (b) providing notice would obstruct an active law enforcement investigation, or (c) notification would create a risk of harm to another person.
• When a non-disclosure period expires, we will notify the affected user as soon as we are legally permitted — unless a renewed order prohibits us from doing so.
• We will never notify a user if doing so would endanger another person’s safety.

5.4 What Data We May Disclose

The type of data we may be required to produce depends entirely on the legal process presented to us:

• Basic account information (name, email address, phone number, registration date, IP address at registration) — may be disclosed in response to a valid subpoena or court order.
• Non-content records (login history, device information, connection logs) — may be disclosed in response to a court order or search warrant.
• Content of private messages and profile information — disclosed only in response to a valid search warrant supported by probable cause. We do not produce message content based on a subpoena or court order alone.
• We never voluntarily disclose sensitive demographic data — including race/ethnicity, gender identity, pronouns, or accessibility information — in response to law enforcement requests, unless we are compelled to do so by a valid search warrant. We take this commitment especially seriously for our LGBTQ+ members and other marginalized communities.

5.5 Emergency Disclosure

In situations involving a credible, imminent risk of death or serious bodily harm — such as a credible threat of violence or an active crisis — we may disclose limited information to law enforcement without a formal legal process. When we do:

• Emergency disclosures are strictly limited to the minimum information necessary to address the emergency.
• We document every emergency disclosure and evaluate whether it met the good-faith standard under 18 U.S.C. § 2702(b)(8).
• We notify affected users of emergency disclosures as soon as it is legally and safely possible to do so.

5.6 Data Preservation

Upon receiving a valid preservation request under 18 U.S.C. § 2703(f), DownTime Dating will preserve a temporary snapshot of account data for up to 90 days, with one 90-day renewal permitted upon request. Important things to know:

• Preservation is not the same as disclosure. We hold the data securely and do not produce it until we receive a valid legal order requiring us to do so.
• Preserved data is stored with strict access controls and is not used for any other purpose.

5.7 International Law Enforcement Requests

DownTime Dating is a U.S.-based platform governed by U.S. law. We apply heightened scrutiny to international law enforcement requests:

• Requests from international law enforcement agencies must comply with applicable Mutual Legal Assistance Treaty (MLAT) processes or U.S. law before we will respond.
• We do not comply with requests from foreign governments that conflict with U.S. law, this Privacy Policy, or the legal rights of our users.
• We apply heightened scrutiny to requests from jurisdictions with documented records of targeting LGBTQ+ individuals, journalists, activists, or marginalized communities — and we will decline requests we believe are designed to cause harm to those individuals.

5.8 Transparency Reporting

We believe accountability requires transparency. DownTime Dating publishes an annual Transparency Report that includes:

• The number of law enforcement requests received, broken down by type (subpoena, court order, search warrant, and emergency disclosure)
• The number of requests fulfilled, rejected, or legally challenged
• The number of users affected by law enforcement requests
• Any national security-related requests, disclosed to the fullest extent the law permits

5.9 Your Rights and Resources

You have rights — and we want you to be able to exercise them. If you believe your data has been improperly disclosed to law enforcement, or if you have questions about a request affecting you:

8. Trauma Informed & Culturally Responsive Practices

We intentionally design our platform to support emotional and cultural safety. This includes:

• Avoiding unnecessary data collection that could put marginalized users at risk

8. Children’s Privacy

DownTime Dating is for adults 25 and older. We do not knowingly collect information from minors.

If you access the app from outside the United States, your information may be processed in the U.S. or other countries with different data protection laws.
